What is Probate?
Probate is the legal process of managing a deceased person’s estate, including their property, money, and possessions. Depending on the deceased situation will depend on what you will receive and /or need to apply for.
- If there is a will, you will receive a Grant of Probate.
- If there is no will, you must apply for Letters of Administration.
How to Apply for Probate
The easiest way to you are ready to start applying for probate is to hire a probate solicitor, who can handle the process on your behalf. To proceed, you will need to provide:
- The total value of the deceased’s estate, including property, bank accounts, funeral expenses, and outstanding debts.
- The original will (if applicable). The will must remain unaltered—any modifications, such as removing and reinserting staples, could lead to rejection by the Probate Office.
Probate Application Process
Once all the required information is gathered, the solicitor will submit the probate application along with the necessary court fee. If there are no complications, the Probate Office will issue:
- A Grant of Probate (if a valid will exists).
- Letters of Administration (if no will exists).
Once these official documents are issued, you will have the legal authority to manage the deceased person’s estate.
