Writing Your Will

Your Will should clearly state:

  1. Who you want to inherit your assets.
  2. Who will care for children under 18.
  3. Who will manage your estate and carry out your wishes (executor).
  4. What should happen if your chosen beneficiaries pass away before you.

When You Need Legal Advice

Our solicitors can provide expert guidance if your Will is more complex. Seek advice if:

  • You share property with someone who isn’t your spouse or civil partner.
  • You want to leave assets to a dependant who cannot care for themselves.
  • You have family members who could contest your Will (e.g., children from another marriage).

Make Sure Your Will is Legal

For a Will to be legally valid in the UK, you must:

  • Be aged 18 or older.
  • Write it voluntarily and of sound mind.
  • Sign it in the presence of two witnesses aged 18 or over.
  • Have your witnesses sign it in your presence.

If you make changes to your Will, the same signing and witnessing rules apply.


Keeping Your Will Safe and Up to Date

  • Inform your executor where your Will is stored so they can carry out your wishes.
  • Review your Will every 5 years or after major life changes, such as:
    • Separation, divorce, or marriage.
    • The birth of a child.
    • Moving house.
    • If your executor passes away.

Making Changes to Your Will

  • Minor Changes: Add an official alteration (called a codicil), which must be signed and witnessed like the original Will.
  • Major Changes: Create a new Will that explicitly cancels all previous Wills and codicils. Destroy your old Will by tearing it up or burning it.
